Terms of Use

Tripomatic s.r.o. (“Tripomatic”) operates this website (the “Site”) and the Tripomatic mobile and web applications, including Tripomatic Trip Planner & Maps and Audio Guides by Tripomatic (together, the “Software”), together with a wide range of information, products, downloads, documents, communications, files, text, graphics, publications, content, tools, and services made available through them.

Please read these Terms of Use carefully before using the Site or the Software. By accessing or using the Site or the Software in any way — including browsing, using any information or content, using any service, downloading any materials, or placing an order — you agree to be bound by these Terms of Use. If you do not agree to all of the terms and conditions contained here, please do not use the Site or the Software.

These Terms of Use are entered into by and between Tripomatic and you. If you are using the Site or the Software on behalf of your employer, you represent that you are authorized to accept these Terms of Use on your employer's behalf.

Tripomatic may update these Terms of Use from time to time — for example, to reflect changes to our services, applicable law, or how we operate.

For minor changes (such as clarifications, corrections, or updates that don't materially affect your rights or obligations), the updated Terms take effect once posted on the Site, and your continued use of the Site or the Software after that point means you accept them.

For material changes (such as changes that materially reduce your rights, materially increase your obligations, or affect the price or core features of a paid licence), we will take reasonable steps to inform you before the change takes effect — for example by e-mail to the address on your account, or by a notice within the Software. If you do not agree to a material change, you may stop using the Software and, where applicable, end your licence as described in “Term and Termination of the Software Licence,” before the change takes effect.

Use of Materials Limitations

All materials contained in the website are the copyrighted property of Tripomatic, affiliated companies and/or third-party licensors. All trademarks, service marks, and trade names are proprietary to Tripomatic, or its subsidiaries or affiliated companies and/or third-party licensors. Unless otherwise specified, the materials and services on this website are for your personal and non-commercial use, and you may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products or services obtained from the website without the written permission from Tripomatic.

Software License

Any software made available for download from the Site or through an app store (the “Software”) is the copyrighted work of Tripomatic and/or its suppliers. Unauthorized use, reproduction, or redistribution of the Software is prohibited by law and may result in civil and criminal penalties. Copying or reproducing the Software to another server or location for further reproduction or redistribution is prohibited, unless expressly permitted by the terms accompanying that Software. Except as expressly warranted in those terms, Tripomatic disclaims all warranties and conditions regarding the Software, including as to merchantability, fitness for a particular purpose, title, and non-infringement.

Tripomatic may also make tools and utilities available as part of the Services, for your convenience. Tripomatic makes no assurance as to the accuracy of the results or output that follow from your use of them, and you must respect the intellectual property rights of others when using them.

Personal, non-commercial use

Licences to use Tripomatic's Software, however acquired — including from the Tripomatic e-shop at tripomatic.com, the Google Play Store, or the Apple App Store — are for personal, non-commercial use only. You may not sublicense, sell, resell, rent, lease, transfer, assign, time-share, reproduce, duplicate, copy, or otherwise commercially exploit the Software or make it available to any third party, unless expressly permitted by these Terms of Use.

Commercial use that is not permitted under this licence includes, without limitation:

• using the Software for the management of assets, or for tracking people, animals, or assets, or similar applications, whether on its own or in combination with third-party software or systems;
• reselling, transferring, or distributing the Software to third parties in any form and for any purpose.

Tripomatic reserves the right to terminate this licence and/or pursue other remedies available to it at law if the Software is used for commercial purposes in breach of these terms.

Using and installing the Software

To use the Software, you must download and install it on a correctly configured device. The Software contains, and is used together with, third-party digital map databases; a list of current map providers appears under Copyright and Trademark Information below, and the terms of use of those map databases are set out on the respective providers' own websites.

Some features of the Software require an internet or data connection. The settings of the device on which you install the Software are your responsibility, as is the payment of any related fees or expenses. You are solely responsible for your use of the Software and for complying with all applicable laws while using it.

Grant of licence

All title and intellectual property rights in and to the Software, including any of its parts (such as map databases), are owned and remain owned by Tripomatic or its suppliers.

Provided you agree to these Terms of Use and have paid any applicable licence fee, Tripomatic grants you: (i) a non-exclusive, non-transferable right to use the Software on any device you own or control, for your personal use, subject to the conditions in these Terms of Use; and (ii) a sub-licence to use third-party map databases to the extent set out in the licence terms of the relevant map providers.

You may make a back-up copy of the Software for archival purposes, provided the original and the back-up remain in your possession and you use the Software only as authorised here.

You may be entitled to future upgrades and updates to the Software and to third-party map databases, although nothing here creates a right to demand them. Where offered, upgrades or updates may require an additional payment, and continuing to use an upgraded or updated version means you accept the then-current Terms of Use.

Limitations on use

You undertake that the device on which you install the Software remains in your possession at all times, and that the Software (including any map database) will be used only by you — except that, where available, it may also be used by other accounts associated with you through Family Sharing or volume purchasing.

You may not copy, distribute, reverse engineer, create derivative works based on the Software, analyse, decompile, or disassemble its source code, or otherwise attempt to obtain its source code, unless expressly permitted by applicable law. You may not use the Software unlawfully or in any way that interferes with or disrupts its integrity, and you may not modify or adapt the Software or attempt to gain unauthorized access to it.

Licence fee

Tripomatic grants you the right to use the Software either free of charge or for a licence fee, depending on the version, features, or specific item you acquire — for example a trial, free, or premium version of the Software as a whole, or an individual in-app item such as a single audio tour. Where a licence fee applies, you agree to pay the fee specified through the channel via which you obtain it — whether an app store (such as the Apple App Store or Google Play) or directly through Tripomatic, for example at tripomatic.com. Once your payment is confirmed — by the app store or, where you paid Tripomatic directly, by Tripomatic — your licence fee is deemed paid.

Delivery and characteristics of the Software

Tripomatic will deliver the Software, an activation key, or access to a specific in-app item (such as an individual audio tour) once any applicable licence fee for it has been paid in full, though it may do so earlier — for example, for a trial version. The characteristics of the Software, and of any such in-app item, depend on the licence type or item acquired and its features, as further described in the app store's or Tripomatic's own product description. That product description reflects ongoing improvements to the Software but does not itself form part of these Terms of Use. Tripomatic may, at its sole discretion, share with you recommendations on how to make better use of the Software.

Tripomatic makes no warranty as to the accuracy or completeness of any map database contained in or used together with the Software. Because geographic data changes over time and comes from many sources, some information may be inaccurate or lead to incorrect results.

Ancillary services

In addition to its basic features, the Software may offer additional features such as navigation, localization, points of interest, information about attractions, monuments, or public transport (in selected cities), and opening hours. Some content and features — including translations, descriptions, and audio narration — may be generated or powered by Google Translate or other artificial-intelligence-based services, and may occasionally be inaccurate or incomplete as a result. Tripomatic maintains user login details for all versions of the Software, and may notify you of any planned maintenance, downtime, or outage.

Use of Artificial Intelligence

Some content and features across our Software are generated, translated, or assisted by artificial intelligence, including: destination and place descriptions, travel guides, translations into other languages, audio narrations, and supporting artwork such as tour cover images. Where AI-generated content is reviewed by our editorial team before publication, this does not guarantee it is free of errors, and AI-generated or AI-assisted content may occasionally be inaccurate, incomplete, or out of date.

You should not rely on AI-generated content — including itinerary suggestions, opening hours, route information, or narration — as a substitute for your own judgement, official signage, or professional advice, particularly where your safety is concerned (for example while walking an unfamiliar route).

If you notice an error in AI-generated content, you can report it at team@tripomatic.com and we will review it.

Use of Documents and Publications on the Website

Except where expressly prohibited on the Site, you may view, copy, print, and distribute publications and documents on the Site (such as FAQs, white papers, datasheets, and press releases), provided that: (a) your use is for informational, personal, and non-commercial purposes only; (b) you do not modify the documents, publications, or graphics; (c) you do not copy or distribute graphics separately from their accompanying text, or quote material out of context; (d) you display the copyright notice and other proprietary notices on every copy you make; and (e) you accept that Tripomatic may revoke this permission at any time, upon which you must immediately stop the related activity.

Use for any other purpose is prohibited by law and may result in civil and criminal penalties. This permission does not extend to the design elements, look and feel, or layout of the Site, which are separately protected by trade dress, trademark, unfair-competition, and other laws, and may not be copied or imitated in whole or in part. No logo, graphic, sound, or image from the Site may be copied or retransmitted without Tripomatic's express permission.

Except where expressly stated otherwise, Tripomatic and its suppliers make no representations about the suitability of the information in these documents and related graphics for any purpose, and provide them “as is,” without warranty of any kind, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Neither Tripomatic nor its suppliers will be liable for any special, indirect, or consequential damages, or any damages resulting from loss of use, data, or profits, arising out of or in connection with the use of this information, whether in contract, negligence, or other tort. These documents and graphics may contain technical inaccuracies or typographical errors, and Tripomatic may change or improve them at any time without notice.

Disclaimers and Other Notices

Except where expressly provided otherwise, all information, software, documentation, materials, services, and publications on the Site are provided “as is,” without warranty of any kind, and Tripomatic disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, title, or quiet enjoyment.

Neither Tripomatic nor its suppliers will be liable for any special, indirect, or consequential damages, or any damages resulting from loss of use, data, or profits, arising out of or in connection with the use of the Site, the Software, or any of the documents, materials, publications, or services described here, whether in contract, negligence, or other tort — except as set out in “Liability for Defects and Damage” below, which sets Tripomatic's liability specifically for defects in paid Software.

You assume all risk concerning the suitability and accuracy of the information on the Site and in its materials, publications, and documents, which may contain technical inaccuracies or typographical errors; Tripomatic disclaims all liability for these, and may change the Site, its information, software, documents, publications, prices, technical specifications, and product offerings at any time without notice.

The Site contains links to third-party sites that are not under Tripomatic's control. Tripomatic is not responsible for the content of any linked site, for any link contained in a linked site, or for any changes to such sites, and provides these links only as a convenience — their inclusion does not imply that Tripomatic endorses or accepts responsibility for the linked site's content.

Accounts and Security

If any of the services on the website requires you to open an account, you must complete the registration process by providing us with true, current, complete and accurate information as prompted by the applicable registration form, and you will maintain and promptly update such information to keep it true, current, complete and accurate. Depending on how you register, you may also choose a password and a user name.

You are entirely responsible for maintaining the confidentiality of your password and account. Furthermore, you are entirely responsible for any and all activities that occur under your account. You agree to notify Tripomatic immediately of any unauthorized use of your account or any other breach of security. Tripomatic will not be liable for any loss that you may incur as a result of someone else using your password or account, either with or without your knowledge. However, you could be held liable for losses incurred by Tripomatic or another party due to someone else using your account or password. You may not use anyone else's account at any time, without the permission of the account holder.

You acknowledge and agree that certain services may provide password-restricted access to customer information such as names and certain terms of your contracts. By using this website and registering for such services, you consent to Tripomatic's display of such information via the services and accept all risks of unauthorized access to such information.

If you provide any information that is false, inaccurate, out of date, or incomplete, or Tripomatic has reasonable grounds to suspect that such information is false, inaccurate, not current, or incomplete, Tripomatic may suspend or terminate your account and refuse any and all current or future use of the services or any portion thereof. You are responsible for all costs and charges, including without limitation, phone charges and telecommunications equipment, that you incur in order to use the services.

Inactive Account Policy

Account Activity Requirements

To maintain an active account, you must log in to your account at least once every 12 months. Failure to meet this requirement may result in your account being classified as inactive.

Inactive Account Management

Tripomatic reserves the right to take the following actions for inactive accounts:

1. Notification: If your account becomes inactive, we will notify you via the email address associated with your account.
2. Account Deletion: If your account remains inactive for 30 days after our notification, we may delete your account and all associated data, subject to applicable laws.
3. Reactivation: If your account is deleted due to inactivity, you must create a new account to access our services again. Deleted data cannot be restored.

Retention of Data

We retain personal data associated with deleted accounts only as necessary to comply with legal and regulatory requirements. For more information, refer to our Privacy Policy.

No Unlawful or Prohibited Use

As a condition of your use of the website, you will not use the website for any purpose that is unlawful or prohibited by these terms, conditions, and notices. You may not use the Services in any manner that could damage, disable, overburden, or impair Tripomatic server. You may not attempt to gain unauthorized access to services, materials, other accounts, computer systems or networks connected to Tripomatic server or to the website, through hacking, password mining or any other means. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available through the website.

Materials Provided to Tripomatic or Posted to the Website

Unless otherwise specified, Tripomatic does not claim ownership of the materials you provide to Tripomatic (including, without limitation, information, ideas, concepts, techniques, feedback, data, questions, comments and suggestions, or the like) or post, upload, input or submit to the website or its associated services for review by Tripomatic, the general public, and/or by the members of any public or private community (each a “Submission” and collectively “Submissions”), and such Submissions shall be deemed not to be confidential.

However, by posting, uploading, inputting, providing or submitting (“Posting”) your Submission you are granting Tripomatic, its affiliated companies and necessary sublicensees permission to use your Submission in connection with the operation of their businesses (including, without limitation, all Tripomatic services), including, without limitation, the license rights to: copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, modify, translate and reformat your Submissions; to publish your name in connection with your Submission; develop, manufacture, and market products incorporating such ideas, concepts, or techniques, and the right to sublicense such rights to any supplier of the services and/or materials on the website. No compensation will be paid with respect to the use of your Submission, as provided herein.

Tripomatic is under no obligation to post or use any Submission you may provide and Tripomatic may remove any Submission at any time in its sole discretion. By Posting a Submission you warrant and represent that you own or otherwise control all of the rights to your Submission as described in these Terms of Use including, without limitation, all the rights necessary for you to provide, post, upload, input or submit the Submissions.

In addition to the warranty and representation set forth above, by Posting a Submission that contain images, photographs, pictures or that are otherwise graphical in whole or in part (“Images”), you warrant and represent that (a) you are the copyright owner of such Images, or that the copyright owner of such Images has granted you permission to use such Images or any content and/or images contained in such Images consistent with the manner and purpose of your use and as otherwise permitted by these Terms of Use and the website, (b) you have the rights necessary to grant the licenses and sublicenses described in these Terms of Use, and (c) that each person depicted in such Images, if any, has provided consent to the use of the Images as set forth in these Terms of Use, including, by way of example, and not as a limitation, the distribution, public display and reproduction of such Images.

By Posting Images, you are granting (a) to all members of your private community (for each such Images available to members of such private community), and/or (b) to the general public (for each such Images available anywhere on the website, other than a private community), permission to use your Images in connection with the use, as permitted by these Terms of Use, of any of the services or materials on the website (including, by way of example, and not as a limitation, making prints and gift items which include such Images), and including, without limitation, a non-exclusive, world-wide, royalty-free license to: copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, modify, translate and reformat your Images without having your name attached to such Images, and the right to sublicense such rights to any supplier of the services and/or materials on the website. No compensation will be paid with respect to the use of your Images.

You acknowledge that Tripomatic does not pre-screen Submissions, but that Tripomatic and its designees have the right (but not the obligation) in their sole discretion to block or restrict access to or the availability of, or to disable, any Submissions that is available via the website. Without limiting the foregoing, Tripomatic and its designees may disable, restrict access to or the availability of, any Submissions that violates the Terms of Use or is otherwise objectionable.

You must evaluate, and bear all risks associated with, the use of any Submissions, including any reliance on the accuracy, completeness, or usefulness of such Submissions. You understand that all Submissions, whether publicly posted or privately transmitted, are the sole responsibility of the person from whom such Submissions originated. This means that you, and not Tripomatic, are entirely responsible for all Submissions that you upload, post, provide, input, submit, or otherwise transmit via the website. Tripomatic does not control the Submissions posted via the website and, as such, does not guarantee the accuracy, integrity or quality of such Submissions. You understand that by using the website, you may be exposed to Submissions from others that are offensive, indecent or objectionable.

User content within the Software

The Software also lets you add, create, upload, submit, distribute, or post your own content, such as photos (“User Content”). Whether posted publicly or transmitted privately, User Content is your sole responsibility. Publicly posted User Content is subject to Tripomatic's prior approval, at Tripomatic's sole discretion; there is no entitlement to have User Content published.

You represent that all User Content you provide is accurate, complete, up to date, and compliant with applicable law. By submitting public User Content, you grant Tripomatic a royalty-free, worldwide, non-exclusive, perpetual, sublicensable, and freely transferable licence to use, edit, modify, reproduce, distribute, prepare derivative works of, display, perform, and otherwise exploit the User Content in connection with the Software — including to promote and redistribute it, in any media and through any channel. This licence does not affect your other ownership or licensing rights in your User Content, and you represent that you hold all rights needed to grant it, without infringing any third party's rights (including privacy, copyright, and trademark rights).

All User Content must be lawful, free of spam, and free of viruses or other malware. In particular, it must not:

• contain material that is defamatory, obscene, indecent, abusive, offensive, harassing, violent, hateful, inflammatory, or otherwise objectionable;
• promote sexually explicit or pornographic material, violence, or discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age;
• infringe any patent, trademark, trade secret, copyright, or other intellectual property right of any person; or
• violate the legal rights (including privacy rights) of others, or contain material that could give rise to civil or criminal liability, or otherwise conflict with these Terms of Use.

Software Distribution and App Store Terms

You may acquire the Software through the App Store, provided by Apple Distribution International, located at Hollyhill Industrial Estate, Hollyhill, Cork, Republic of Ireland, and other companies of the Apple group (together, “Apple”), through Google Play, or through other sources; you may also access the web app at maps.tripomatic.com. Where a price applies, you will be able to choose the Software you want and its price will be notified to you in advance.

You accept these Terms of Use as they apply to the Software, and express your consent to be bound by them, by purchasing the Software. If you do not agree, you are not permitted to download, install, or use the Software; if you have already installed it, you must uninstall it and destroy all copies. You may not use the Software, and may not accept these terms in relation to it, if you are not of the legal age required to do so, or if you are barred from using the Software under applicable law.

To the extent permitted by applicable law, you and Tripomatic acknowledge that Apple is a third-party beneficiary of these Terms of Use as they apply to the Software, and that Apple has the right to enforce them against you.

You and Tripomatic acknowledge that, in the event of any third-party claim that the Software, or your possession and use of it, infringes that third party's intellectual property rights, Tripomatic — not Apple — will be solely responsible for the investigation, defence, settlement, and discharge of any such claim.

You represent and warrant that (i) you are not located in a country subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country, and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

Tripomatic's contact details, and other information Tripomatic is required to disclose under applicable Czech law, are available on this website.

Liability for Defects and Damage

This section supplements, and takes precedence over, the general disclaimer above with respect to defects in the Software you have purchased.

Tripomatic is liable for defects in the Software and in any upgrade or update to it. Because the trial and free versions of the Software are provided free of charge, Tripomatic is not liable for defects in a version of the Software installed as a free or trial version.

Tripomatic bears no responsibility for any inaccuracy, incompleteness, or other defect in any map database used together with the Software — liability for that is governed by the licence terms of the relevant map provider. Tripomatic is likewise not liable for User Content, for its errors, inaccuracies, or incompleteness, or for any ancillary service described above, including for inaccurate or out-of-date information about an attraction, monument, point of interest, or opening hours; errors in route calculation; inaccuracies in translated text; or inaccurate public-transport information. Tripomatic is also not liable for inputs you provide, such as your choice of destination, route, or toll avoidance — you are solely responsible for the correctness of your own inputs.

Tripomatic warrants that the Software will perform substantially in line with its documented specifications, but does not warrant that the Software, or the results it produces, will meet your requirements or will be uninterrupted, error-free, or available at all times. Tripomatic is not responsible for any failure of the Software caused by something outside its reasonable control, such as insufficient GPS signal.

You acknowledge that, due to ongoing improvement of its software products, Tripomatic may decide to cease providing technical support for a particular version of the Software, which may result in that version no longer being interoperable with other software on your device. If you do not upgrade the Software to a newer version, Tripomatic bears no responsibility whatsoever for any resulting interoperability issues, defects, or malfunctions of the software (including the Software) on your device.

Tripomatic is liable for damage only where there is a causal connection between the damage and the Software.

Technical Support and Complaints

Tripomatic provides technical support, which you can request at support.tripomatic.com. Your request should be detailed enough for our support team to resolve the reported issue, and we may decline to provide support if you do not cooperate as needed. We are not obliged to provide support, and are not responsible for a defect, where the issue reported results from unauthorized interference with the Software, incorrect settings, or use of the Software in a way that conflicts with these Terms of Use or the app store's product description. Any technical information you provide as part of a support request or complaint may be used by Tripomatic internally for support and development.

If you believe the Software has a defect and cannot submit a support request through support.tripomatic.com, or are dissatisfied with the support you received, you can send a complaint to team@tripomatic.com. We will confirm receipt of your complaint without undue delay, and will tell you how the matter will be handled without undue delay — within 3 business days for more complex cases, and within 30 days where a full technical assessment is needed. We will handle the complaint within 30 days of receiving it and confirm once it has been resolved.

If the Software has a defect, or the support we provide is defective, you are entitled to have it fixed free of charge, promptly, and properly; Tripomatic will remove the defect without undue delay, or may replace the Software with a version free of the defect. If a defect cannot be fixed and prevents proper use of the Software, or recurs after repair, or occurs alongside a larger number of defects, you have the right to exchange the Software, or to end this licence. On termination, Tripomatic will refund the part of the licence fee that corresponds to the period during which the Software was not in conformity. Send any such termination notice to the e-mail address above.

If you have your domicile or habitual residence in the European Economic Area and a dispute with us cannot be resolved directly, you may bring a complaint to the Czech Trade Inspection (www.adr.coi.cz) within one year of first raising your claim with us, along with evidence that you tried to resolve it with us directly first.

If the Software fails to conform to any applicable warranty, you may instead notify Apple, which will refund the licence fee according to Apple's own refund policy; Apple has no other warranty obligation regarding the Software, and any other claim relating to a failure to conform to warranty remains Tripomatic's sole responsibility.

Unsolicited Idea Submission Policy

Tripomatic and its employees do not accept or consider unsolicited ideas — including ideas for new advertising campaigns, promotions, products, technologies, processes, materials, marketing plans, or product names — and we ask that you not send us any original creative artwork, samples, demos, or other works. This policy exists solely to avoid misunderstandings or disputes if Tripomatic's own products or marketing strategies happen to resemble ideas that were submitted to us. If, despite this request, you do send us your ideas or materials, please understand that Tripomatic makes no assurance that they will be treated as confidential or proprietary.

Indemnity

You agree to indemnify, defend and hold Tripomatic, and its subsidiaries, affiliates, officers, agents, co-branders, partners, and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your Submissons, your use of the website, including any use by your employees, your connection to the website, your violation of the Terms of Use, or your violation of any rights of another.

Advertisements and Promotions

Tripomatic may run advertisements and promotions from third parties on the website. The manner, mode and extent of advertising by Tripomatic is subject to change. Your correspondence or business dealings with, or participation in promotions of, advertisers other than Tripomatic found on or through the website, including payment and delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such advertiser. Tripomatic is not responsible or liable for any loss or damage of any kind incurred as the result of any such dealings or as the result of the presence of such non-Tripomatic advertisers on the website.

Confidentiality

At all times during and after these Terms of Use, you will keep confidential, and not disclose or use for your own benefit or that of any other person or entity, any confidential information belonging to Tripomatic or its third-party data providers. For this purpose, confidential information means any trade secret or other information — whether written, digital, oral, or in any other form — that is unique or confidential to Tripomatic or its third-party data providers.

The Software uses third-party digital map data. Current map providers include OpenStreetMap (openstreetmap.org/copyright/en); use of that data is subject to the relevant provider's own terms.

Governing Law

These Terms of Use are governed by and construed in accordance with the law of the Czech Republic. The United Nations Convention on Contracts for the International Sale of Goods is expressly excluded. Statutory rules on the mandatory application of national or international consumer-protection law remain unaffected.

Term and Termination of the Software Licence

This section applies to your licence to use the Software specifically, rather than to your general use of the Site.

The licence takes effect once concluded, as described in “Software Distribution and App Store Terms” above, for the period stated in the app store's product description. You may end it at any time, with immediate effect, by uninstalling all copies of the Software.

You may withdraw from the licence without giving a reason within 14 days of concluding it, and receive a full refund of the licence fee, to the extent this right applies to your purchase under applicable law. Where you purchased through an app store, notify Apple or Google Play, as applicable, who will process the refund under their own refund policy. Where you purchased directly through Tripomatic, notify Tripomatic at team@tripomatic.com, and Tripomatic will process the refund.

Tripomatic may end the licence with immediate effect if you substantially fail to comply with it, by sending notice to the e-mail address you have provided; that notice takes effect when it is delivered, or when Tripomatic receives a reply confirming it could not be delivered. Where the Software is installed as a trial version, the licence lasts only for the trial period, and the Software may include functionality that disables it once the trial period expires.

Tripomatic is not obliged to refund the licence fee where the licence ends because you substantially failed to comply with it. Where you receive a refund of your licence fee from Apple as described in “Technical Support and Complaints” above, the licence ends as a result.

Once the licence ends, you must stop using the Software and uninstall all copies of it. Provisions that are by their nature intended to survive termination — such as those on confidentiality, limitations of licence, liability for defects and damage, and governing law — remain in effect after the licence ends.

General Information

The Terms of Use constitute the entire agreement between you and Tripomatic and govern your use of the website, superseding any prior agreements between you and Tripomatic on the subject matter (including, but not limited to, any prior versions of the Terms of Use). Notwithstanding the prior provision, to the extent, and only to the extent, that any terms set forth in this Terms of Use expressly contradicts any terms of a prior written agreement between you and Tripomatic in effect as of the date of your use of the website and specifically regarding your use of the website (“Executed Agreement”), such contradictory terms set forth in the Executed Agreement shall govern.

You also may be subject to additional terms and conditions that may apply when you use other Tripomatic services, third-party content or third-party software. The failure of Tripomatic to exercise or enforce any right or provision of the Terms of Use does not constitute a waiver of such right or provision. If a court of competent jurisdiction finds any provision of the Terms of Use to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the Terms of Use remain in full force and effect.

Regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the website or the Terms of Use must be filed within one (1) year after such claim or cause of action arose or be forever barred. The section titles in the Terms of Use are for convenience only and have no legal or contractual effect.

You may not transfer this licence or assign your rights under these Terms of Use to a third party without Tripomatic's prior written consent.
